Sectional Properties
Service Description
This service supports developers in registering sectional properties such as apartments, offices, and other multi-unit buildings. It is guided by the Sectional Properties Act, 2020 (Section 11), the Physical and Land Use Planning Act (PLUPA), Section 57, and other relevant land laws. The process ensures that each unit in a building has its own title, making it legally distinct and transferrable. Why it matters: Sectional property registration is essential for developers who intend to sell or lease out individual units within a building. It allows for the issuance of separate titles to each unit, unlocking financing opportunities, improving transparency, and ensuring compliance with Kenya’s legal framework on property subdivision and planning. Failure to register sectional properties correctly can lead to delays in sales, disputes over ownership, and regulatory penalties. For: Developers creating multi-unit properties requiring individual titles. Client Requirements, (Submit via LSS’s secure upload portal): -Ownership documents (title deed or lease certificate for the parent parcel, per Land Registration Act, 2012, Section 25) -Recent land search (conducted within the last 3 months, per Land Registration Act, 2012, Section 34) -Survey plan or cadastral map of the parent parcel (per PLUPA Section 57(1)) -Draft or final sectional plan prepared by a licensed surveyor (per Sectional Properties Act, 2020, Section 11(1)) -Architectural plans of the building (per Sectional Properties Act, 2020, Section 11(2)) -Proof of land rent payment or clearance certificate (mandatory for leasehold properties, per Land Act, 2012, Section 32) LSS Requirements -Prepare application for sectional property registration, including Form PLUPA/DC/1A if tied to a development application (per PLUPA Section 57(2)) -Draft public notification notice for publication in two daily newspapers (if zoning or land use changes are involved, per PLUPA Section 58(7)) -Draft on-ground public notification notice for posting at the site (if required, per PLUPA Section 58(8)) -Develop a standardized planning brief detailing the sectional property’s compliance with county plans and building regulations (per PLUPA Section 57(3) and Sectional Properties Act, 2020, Section 12) -Coordinate with licensed surveyor and Land Registrar for sectional plan registration (per Sectional Properties Act, 2020, Section 13)
