Service Description
This service supports property owners in applying for lease extensions for residential, commercial, or mixed-use properties. It aligns with Section 13 of the Land Act, 2012, and PLUPA Sections 57 and 58. LSS prepares and submits Form PLUPA/DC/3, advises on engagement with the National Land Commission (NLC) or county government, and supports responses to public objections where required. Why It Matters Expiring leases can impact ownership rights, development plans, or property transactions. Early, well-prepared applications help secure long-term tenure, ensure compliance with planning frameworks, and reduce risks of delays or objections. LSS guides clients through the technical and procedural requirements to ensure a strong application. Who Should Undertake Lease Extension Applications Property owners or estate managers with leasehold titles nearing expiry who intend to retain ownership, secure financing, or redevelop the property. Client Requirements (to be submitted via LSS’s secure upload portal): -Ownership documents (lease certificate, as per Land Registration Act, 2012, Section 25) -Recent land search (issued within the last 3 months, as per Section 34) -Copy of the current lease agreement (Land Act, 2012, Section 13(1)) -Survey plan or location plan (PLUPA Section 57(1)) -Proof of land rent payment or clearance certificate (mandatory under Land Act, 2012, Section 32) LSS Requirements: -Prepare Form PLUPA/DC/3 for submission (PLUPA Section 57(2)) -Draft public notification notice for publication in two daily newspapers (if required by NLC or county, PLUPA Section 58(7)) -Draft on-site public notice for posting at the property (PLUPA Section 58(8), if applicable) -Develop a planning brief demonstrating alignment with county land use and development frameworks (PLUPA Section 57(3)) -Advise on coordination with NLC and how to address potential objections (Land Act, 2012, Section 13(2))
